There are so many people out there that would love to get their hand on a child. I’m not speaking of loving parents with goods homes, I speaking of the wide variety of sicko’s out there who only have the worst intentions. Thank God none of them were luring around a California Wal-Mart this Wednesday, the same time the Patrick Fousek and Samantha Tomasini where , or they may have gotten their wish.
Police were called after 2 women in the Wal-Mart parking lot were approached by Fousek 30, who initially just asked to use the women's cell phone. The women pulled out her cell phone and politely commented on how cute the 9 month old baby was Fousek was holding. He replied to niceness by offering to sell the baby to her for $25. Initially the women laughed it off, assuming Fousek was joking, I mean, who would take such a remark seriously? The women’s laughs soon turned to confusion and concern as Fousek allegedly thrusting the baby towards the women, grabbing a shopping cart, and trying to walk away leaving his little girl in her arms .
This continued on for over 10 minutes before police say Fousek grabbed the 9 month old and got into his car. The mother of the baby, Tomasini, 20, had been sitting inside of the car silent, throughout the whole ordeal. As the couple left the parking lot, the shocked women who was just offered a baby, took down the vehicle's description and license plate as she called the police.
It wasn’t long before Officers located the couple and the baby at their apartment. Both parents were quickly charged with felony child endangerment, Fousek also receiving an additional charge for violating probation and Tomasini, dissuading a witness, prosecutors declined to reveal why, and taken to Monterey County Jail. While observing the home, Officers made a shocking discovery. They found the baby in horrible living conditions, with both parents allegedly under the influence of methamphetamine. CPS was soon called to take the baby after rotting food, piles of clothing, and drug paraphernalia were found throughout the home. Tomasini, who seems to be a lot darker than bright, allegedly told the CPS worker she breastfed the baby while under the influence of drugs.
As the couple awaiting their Friday arraignment, Fousek was beaten up by other inmates, after details of the case were reported on the T.V. I guess trying to sell your baby for $ 25 is a no no even by inmate standards. He was taken to a nearby hospital and treated for 2 cracked ribs and multiple injuries to his face. Fousek’s now has the luxury of spending the rest of his time in protected seclusion. . Before court, as the couple was being put into a van, Fousek said to Central Coast News crews "It was just a joke." I guess the inmates didn’t think it was very funny, because at the arraignment, Fousek's was sporting a well deserved swollen black eye and a busted lip.
Inside the court room, his girlfriend Samantha Tomasini, showed the tale tale signs of being controlled and abused. She stood nodding her head and mumbling the word "baby" as Fousek watched and smirked.
With their records being pulled in court, it proved not to be their first time in front of a judge. The Court records showed deputies had busted into Fousek's home in 2006. Inside they found a working meth lab, as well as a three year old boy.
Fousek's criminal record dates back to 1994. It includes arrests for drug possession, violating a protective order for domestic violence, two DUI's and driving with a suspended license 7 times.
As for Tomasini, she may have been pregnant when she tested positive for meth, cocaine and marijuana in February 2009.
Police say in the past three months, they responded to the couple's apartment on six different occasions. Neighbors called to complain about everything from a crying baby, to domestic violence, even a suspected meth lab.
The couple both pled not guilty through public defenders, their next hearing is on July 9th where they both face another long list of charges. If found guilty, the couple could spend up to four years in jail for the child endangerment charges in addition to the lesser offenses of possession of a controlled substance. In my opinion, it’s going to take a lot more than four years to straighten these two degenerates out.
